Terms and conditions of sale

1. Scope

These terms govern sales between SANSIL 3D (Sébastien Boudignon, sole trader, SIRET 940 902 281 00010) and its customers, whether businesses or consumers.

Placing an order implies unreserved acceptance of these terms. They prevail over the customer's own purchasing conditions unless otherwise agreed in writing.

2. Products and services

SANSIL 3D produces parts by FDM additive manufacturing, together with computer-aided design and reverse-engineering services.

Parts are made to order, from a file supplied by the customer or modelled by SANSIL 3D. They do not come from stock.

Unless otherwise stated in writing, no post-processing is carried out beyond removal of print supports. The layer lines characteristic of the process remain visible and do not constitute a defect.

3. Quotations and orders

Every order is preceded by a written quotation, valid for 30 days from issue. Estimates displayed on the site are indicative and do not constitute a firm offer.

The order becomes binding once SANSIL 3D receives the customer's written acceptance of the quotation. For runs above 50 pieces, production only starts after written approval of a sample.

SANSIL 3D reserves the right to refuse an order, in particular where the requested part infringes an intellectual property right, presents a safety risk, or exceeds its technical capabilities.

4. Prices and payment

Prices are stated in euros and exclude shipping, which is charged separately and shown on the quotation. The applicable VAT status is set out in the legal notice and repeated on every invoice.

Unless agreed beforehand, the first order is payable in full at the time of ordering. Subsequent orders may be settled at 30 or 60 days end of month, once the customer account has been approved.

Under articles L.441-10 and D.441-5 of the French Commercial Code, late payment between businesses automatically incurs interest at the European Central Bank rate plus 10 points, together with a fixed recovery charge of €40.

5. Manufacturing and delivery times

The times shown on the quotation run from written acceptance of the order and, where applicable, from approval of the sample.

A delivery delay gives rise to neither cancellation nor compensation, save for gross negligence by SANSIL 3D or an overrun of more than 30 days on the stated time.

For consumers, under article L.216-2 of the French Consumer Code, where the stated time is exceeded the order may be cancelled by registered letter after a formal notice has gone unanswered.

6. Transfer of risk and title

Risk passes when the parcel is handed to the carrier for business customers, and on actual receipt by the consumer (article L.216-4 of the French Consumer Code).

SANSIL 3D retains title to the goods until the price is paid in full, under article 2367 of the French Civil Code.

7. Conformity and complaints

The customer has 14 days from delivery to report a non-conformity, by email to support.sansil3d@gmail.com, with photographs.

If the non-conformity is attributable to SANSIL 3D, the parts are remade at no charge, shipping included. If it results from a dimensional error in the file or in the information supplied by the customer, a quotation for the rework is issued before anything is remade.

Parts conforming to the approved file cannot be returned on the ground that they do not suit the intended use, that use being the customer's responsibility.

8. Statutory guarantees

Consumers benefit from the statutory guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code), independently of any commercial warranty.

The statutory guarantee of conformity runs for two years from delivery. The consumer chooses between repair and replacement, subject to the cost conditions provided by law.

Action for hidden defects must be brought within two years of the defect being discovered.

9. Right of withdrawal — the made-to-order exception

Consumers normally have 14 days to withdraw from a distance purchase, without giving a reason.

This right does not apply to goods made to the consumer's specifications or clearly personalised, under article L.221-28 3° of the French Consumer Code. That covers virtually everything we make: each part is produced from the file, the dimensions and the material chosen by the customer, and cannot be put back on sale.

This exclusion is restated before each order is confirmed. It removes none of the statutory guarantees set out in article 8.

As long as manufacturing has not begun, the order may be cancelled free of charge on simple request.

10. Intellectual property in files

The customer warrants that they hold the necessary rights in the files they send, and indemnifies SANSIL 3D against any third-party claim in that respect.

SANSIL 3D refuses any order for a model under a non-commercial licence, for an object protected by a trade mark or copyright, or for a part covered by a patent in force.

Customer files are used solely to fulfil the order and are deleted on request.

11. Liability

Parts made by SANSIL 3D are not intended for safety, lifting or pressurised applications, nor for lasting food contact, save by express written agreement covering an identified material and use.

SANSIL 3D's liability is limited to the amount of the order concerned. It cannot be engaged for indirect damage, in particular loss of business.

12. Force majeure

SANSIL 3D cannot be held liable for a failure resulting from an event of force majeure within the meaning of article 1218 of the French Civil Code, in particular a break in raw-material supply, a major equipment breakdown or a power-network failure.

13. Consumer mediation

Under article L.612-1 of the French Consumer Code, consumers may use a consumer mediator free of charge to seek an amicable settlement of a dispute, after sending a written complaint to SANSIL 3D and failing a satisfactory reply within two months.

14. Governing law and jurisdiction

These terms are governed by French law.

In the event of a dispute with a business customer, and failing amicable settlement, jurisdiction lies with the courts of Évry-Courcouronnes.

Consumers retain the right to bring proceedings before the court of their place of residence or of the place where the service was performed.
